Family Elder Law's Penrod Seeks Revocation of Law License, Dismissal of Pending Disciplinary Cases in Petition for Florida Supreme Court

Family Elder Law owner and attorney Jason Penrod has filed a petition with the Florida Supreme Court acknowledging the misuse of client living trust funds and requesting the disciplinary revocation of his law license.

Jason Penrod has voluntarily petitioned for the revocation of his law license "with leave to re-apply" after admitting he misused client trust funds. He pledged to reimburse the missing funds.

The petition, filed by Penrod's attorney Richard Allen Greenberg, states that Penrod admits his violation of the strict rules governing attorney practices, and pledges to "reimburse the Client Security Fund (CSF) for any and all funds CSF has paid or may pay out for claims resulting from the petitioner's misconduct," as well as $1250 for court costs in the disciplinary matter.

The CSF guarantees the reimbursement to legal clients of all funds placed in trust accounts.

Penrod, 47, had operated Family Elder Law since 2013, growing it to three offices including Lake Wales, Sebring, and Lakeland. The firm closed suddenly and unexpectedly last month, leaving both clients and employees in the dark.

In Penrod's filing he voluntarily agrees to "submit to a complete audit of any trust account(s) and any other account(s) in which petitioner has placed client funds, if requested to do so by the Florida Bar."

The petition was filed in response to two cases initiated by the Florida Bar. Penrod's petition for revocation, filed under the rules of the Bar, also requests leave to "reapply for readmission" and states that Penrod had no prior disciplinary actions against him.

Family Elder Law on Tillman Avenue in Lake Wales was one of three offices operated by teh firm.

Penrod has agreed to remove all indications of his former status as an attorney on "email, social media, telephone listings, stationery, checks, business cards, office signs, or any other indicia." He also agrees to submit to keep the bar advised of his home address for five years.

The petition before the court states that "granting this petition will not adversely affect the public's interest, the integrity of the courts, or the confidence of the public in the legal profession," and seeks to "dismiss all pending disciplinary cases."

Penrod served as a president of the Lake Wales Area Chamber of Commerce in 2010 as well as the Lake Wales Noon Rotary Club. He is well known in social circles and has many friends in the business community.
